- Inspection and Acceptance
The Buyer confirms that the material has been thoroughly inspected, verified, and approved prior to purchase. By proceeding with the transaction, the Buyer acknowledges satisfaction with the quality, specifications, color, finish, and overall condition of the material.
Accordingly, the Buyer shall not raise any claim, dispute, or objection against the Seller after the sale on account of quality concerns, variation in natural characteristics, or change of mind, nor request return of goods or refund under any circumstances.
- Sale on “As Is, Where Is” Basis
The material is sold strictly on an “as is, where is” basis, with all inherent natural variations, including but not limited to color, texture, veins, fissures, and shade differences, which are characteristics of natural stone. Every order is produced especially for each buyer as per their specifications so it is customised and it cannot be returned nor the amount be refunded if the buyer changes his mind about the purchase afterwards.
The Seller shall bear no responsibility or liability for the material once it has been dispatched from the factory or handed over to the transporter.
- Post-Delivery Liability
The Seller shall not be liable for any damage, breakage, loss, or deterioration occurring during transit, unloading, storage, handling, fabrication, installation, or post-installation use.
Any such risks shall be solely borne by the Buyer.
- Warranty
The Seller provides no express or implied warranties, including but not limited to warranties of merchantability or fitness for a particular purpose. All materials are supplied without any guarantee beyond pre-dispatch approval.
- Claims and Notifications
No claims of any nature shall be entertained after dispatch of the material. Any concerns must be raised and resolved prior to dispatch.
- Force Majeure
The Seller shall not be held responsible for any delay or failure in performance due to circumstances beyond its reasonable control, including but not limited to natural disasters, strikes, transport disruptions, governmental actions, or other unforeseen events.
- Governing Law and Jurisdiction
Any dispute arising out of or in connection with this transaction shall be governed by the laws of India.
All disputes shall be subject to the exclusive jurisdiction of the competent courts located in the Delhi NCR region, India.
